AIF-BIN Studio & Tools

Welcome to AIF-BIN Studio (the "App"), including the ingestor, inspector, viewer, writer, and related tools, operated by Terronex.dev ("we", "us", or "our").

By downloading, installing, accessing, or using the App (or any part of it), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. The App & Its Purpose

The App is a local-first software tool that lets you:

Ingest files (PDFs, documents, images, etc.) and convert them into .aif-bin format
Inspect, analyze, view, and edit .aif-bin files
Use your own AI API keys (Google Gemini, Ollama, Llama, etc.) to add intelligence to files
Search semantically across your ingested content
Export original files and extracted content

The App processes files locally on your device by default. When you choose cloud AI mode, files or portions you explicitly send are transmitted to third-party AI providers.

2. Beta / Experimental Status

The App is currently in beta / early-access status. This means:

Features may be incomplete, unstable, or change without notice
Bugs, data loss, or unexpected behavior may occur
We do not guarantee uptime, accuracy, or fitness for any particular purpose
You use the App at your own risk
The .aif-bin format specification may evolve; backward compatibility is not guaranteed during beta

Recommendation: Always maintain backups of your original files.

3. Your Account & Responsibilities

Your Responsibilities

You are solely responsible for:

Securing your AI API keys — we do not store, access, or have visibility into your keys
Backing up your .aif-bin files and original content
Complying with all applicable laws when using the App
Ensuring you have rights to ingest, process, and store any files you use

Prohibited Uses

You may NOT:

Use the App for any illegal purpose
Ingest, process, or store content that you do not have the legal right to use
Use the App to process illegal content
Reverse-engineer, decompile, or extract source code (except where permitted by law)
Distribute modified versions of the App without permission

4. Intellectual Property

Our Property

The following are owned by Terronex.dev or our licensors:

The App (software, code, design, user interface)
The AIF-BIN format specification and documentation
All trademarks, including AIF-BIN™ and Recall OS™

Your Content

Your .aif-bin files and original content remain your property. We claim no ownership over:

Files you ingest into the App
.aif-bin files you create
Any content, data, or intellectual property you process

5. Third-Party Services

When you use cloud AI modes (e.g., Google Gemini API):

Your files or content portions are sent to the third-party provider
Their terms of service and privacy policy apply
We are NOT responsible for their actions, data handling, security, or service availability

6. Fees & Payments

The App may be offered as free, freemium, one-time purchase, or subscription
Prices are subject to change with reasonable notice
Digital products are generally non-refundable after download/activation
Refund requests must be made within 14 days of purchase

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY OF RESULTS

Some jurisdictions do not allow the exclusion of implied warranties, so some exclusions may not apply to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

WE SHALL NOT BE LIABLE FOR ANY:

Indirect, incidental, special, consequential, or punitive damages
Loss of data, files, or content (including .aif-bin files)
Loss of profits, revenue, or business opportunity

OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF:

The amount you paid us in the 12 months preceding the claim, OR
One Hundred US Dollars ($100)

9. Indemnification

You agree to indemnify, defend, and hold harmless Terronex.dev from any claims, damages, losses, liabilities, costs, and expenses arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice.

Upon termination:

Your license to use the App ends immediately
Your .aif-bin files remain on your device; we do not delete your local files

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles.

Informal Resolution First: Before filing any legal claim, contact us at legal@terronex.dev and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If we cannot resolve the dispute informally, disputes shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA).

Class Action Waiver: You agree to resolve disputes only on an individual basis and waive any right to participate in class actions.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new "Last Updated" date. For material changes, we will provide notice in-app or via email. Continued use after changes constitutes acceptance.
